Bootlegs Illegal?

Are Bootleg Patches illegal even tho the copyright isn't on the patch?

Bootlegs are always illegal, no matter what is or isn't written on them.... that's why they're called bootlegs.

Why does for example Riffsmerchandise, some producers/distros, eBay etc. Have them up for sale? Are they illegal but no fed or customs give a shit?

If the originator does not take action in this regard, then nothing happens. Some people don't care, some simply don't notice when mini editions of 100 bootlegs are made, and in many countries you simply can't take action against it because of the legal situation there. There are various reasons.

Most bands dont take action since it's just publicizing their band merch and promoting their music, and most enjoy that people enjoy their merch. When the bootlegs make more money than the official product, thats when the bands get angry or takes a direction they dont like.

A lot of official merchandise now is so wretched and low quality it should be illegal

That has some truth to it, official merch for bigger bands is just getting lower and lower quality.

Yeah and meanwhile the bootlegs keep getting better and better. Compare what Outer Garments or Fullmoon are doing with some Gildan Softstyle nonsense you’d get from the official websites, they don’t even try anymore

Intellectual property varies from country to country. Generally speaking, the owner of musical intellectual property owns stuff like the music, the writing credits, the art, and logos. When it comes to the law, it's much more complicated than that, but it doesn't matter so much for this conversation. So, the copyright holder doesn't need to have a patch specific copyright. A violation of intellectual property rights occurs when someone who doesn't have permission uses copyrighted material to created new material without permission. This isn't "illegal" per se, but it is usually an enforceable violation of someones rights. Whether or not one tries to enforce it is up to the copyright holder.

Think of it like you own a house on the corner of a block and people cut across your lawn to get around the corner faster. Sometimes this may legit harm you. Too many people do it and they wear a path in your yard that you have to fix. Maybe someone sets up a freaking toll booth in your yard and starts charging access to your stuff. This is a dick thing to do. Sometimes the people cutting through your yard may actually help you. People notice your yard and how you run a business out of your house. They probably would have never noticed if someone hadn't told them about it. Sometimes you're Bolt Thrower and you call the cops on every person that even looks like they might stray a toe onto your property.

If you support a band try to buy licensed merch as much as possible. Thats always a good rule of thumb.

It seems that every seller I see selling exclusively bootlegs lives in a country with very loose laws surrounding it. Either that or it would be tough and almost impractical to do something about it.

I wouldn't say that's very true sure there's the asian bootlegers that mostly copy old merch with out putting a lot of creativity in to the t shirt they are creating but those are few and far in between there's for example goth brook's, bootsbloodyboots, fairy wearboots,baystatebootlegs and ect they still do bootleg reprints of bands and i haven't really seen bands send alot of warings about bootlegging their merch and most of the times bands either have no good merch left or no merch at all it's also kinda sad because bands like glassjaw who haven't done shit im forever send warnings to actual good bootlegers like boothammertees and it's kinda funny because they haven't done anything in forever and then if a older Glassjaw fan decides that he wants to have something again of them they either have to stick up with extremely shitty hoodies, t shirts and long sleeves or pay up to 400$ for a glassjaw t shirt and 500-600$ for an old hoodie that's probably not older than 15-26/27 years
