Bootlegs are always illegal, no matter what is or isn't written on them.... that's why they're called bootlegs.

Why does for example Riffsmerchandise, some producers/distros, eBay etc. Have them up for sale? Are they illegal but no fed or customs give a shit?

If the originator does not take action in this regard, then nothing happens. Some people don't care, some simply don't notice when mini editions of 100 bootlegs are made, and in many countries you simply can't take action against it because of the legal situation there. There are various reasons.

Most bands dont take action since it's just publicizing their band merch and promoting their music, and most enjoy that people enjoy their merch. When the bootlegs make more money than the official product, thats when the bands get angry or takes a direction they dont like.

That has some truth to it, official merch for bigger bands is just getting lower and lower quality.

Yeah and meanwhile the bootlegs keep getting better and better. Compare what Outer Garments or Fullmoon are doing with some Gildan Softstyle nonsense youβd get from the official websites, they donβt even try anymore

Intellectual property varies from country to country. Generally speaking, the owner of musical intellectual property owns stuff like the music, the writing credits, the art, and logos. When it comes to the law, it's much more complicated than that, but it doesn't matter so much for this conversation. So, the copyright holder doesn't need to have a patch specific copyright. A violation of intellectual property rights occurs when someone who doesn't have permission uses copyrighted material to created new material without permission. This isn't "illegal" per se, but it is usually an enforceable violation of someones rights. Whether or not one tries to enforce it is up to the copyright holder.
Think of it like you own a house on the corner of a block and people cut across your lawn to get around the corner faster. Sometimes this may legit harm you. Too many people do it and they wear a path in your yard that you have to fix. Maybe someone sets up a freaking toll booth in your yard and starts charging access to your stuff. This is a dick thing to do. Sometimes the people cutting through your yard may actually help you. People notice your yard and how you run a business out of your house. They probably would have never noticed if someone hadn't told them about it. Sometimes you're Bolt Thrower and you call the cops on every person that even looks like they might stray a toe onto your property.
